PLEASE CAREFULLY READ THESE TERMS AND CONDITIONS OF USE AND THE PRIVACY POLICY BEFORE USING THIS WEBSITE. 
 
When a Member or user submits information to BidMuseum.com ("BidMuseum"), either by visiting or using the BidMuseum website (www.BidMuseum.com) (each, the "Site") or by registering for or using any BidMuseum products or services available on the Site (each a "Service" and collectively, the "Services"), said Member agrees to be bound by these terms and conditions (the BidMuseum "Terms of Use", the BidMuseum Privacy Policy (the "Privacy Policy") and the Official Rules of each individual auction (in each case, the "Rules"). All of the terms and conditions contained in the Rules and the Privacy Policy are deemed incorporated into these Terms of Use by this reference. In the event of a conflict between the Terms of Use, Privacy Policy or any Rules, the Terms of Use shall supersede the Privacy Policy or any other Rules. 

BidMuseum has the sole discretion to, whenever it deems fit, update or alter these Terms of Use, the Privacy Policy and the Rules without prior notice to Members or users. Members or users are encouraged to periodically check these Terms of Use, the Privacy Policy and the Rules.  Should a Member or user disagree with any of the terms and conditions of the Terms of Use, Privacy Policy or any Rules, their authorization to access or use the Site or any Service shall cease, and their sole remedy shall be to refrain from further accessing or using the Site and its Services. Should a Member or user continue to use the Site or Services and/ or participate in the BidMuseum Program, said Member or user shall be construed as having accepted the prevailing Terms of Use, Privacy Policy and any Rules, including any updates or changes therein. 

BidMuseum has the express permission of Members and users to contact them via e-mail about various aspects of the Services and the BidMuseum Auction Program. 


Eligibility Requirements
 
Members and users represent that they (i) are a legal resident of a country that is authorized by PayPal to do business; (ii) have reached the age of majority within the jurisdiction of their residence; (iii) are not barred from receiving Services due to laws in their jurisdiction or third party contracts or obligations.  In countries where Services are prohibited by law, said Services shall be void. Access to and use of the Site and the Services are limited to users in countries where PayPal is accepted with some exceptions, in which case some of the users in countries accepting PayPal may also be denied access or use. 
 
Participation in BidMuseum Auctions is limited to Members of BidMuseum. A "Member" is an individual who is legally eligible to use the Service, and who has duly filled the registration form. In order to become a Member of BidMuseum.com, users must fully and accurately complete the BidMuseum registration form, which may require the provision of the user’s names, mail and e-mail addresses, phone number and age. It is the responsibility of each user to update the information stored at BidMuseum.com, as required by the Registration Form, in the event that changes are made with regard to such information. Members shall not (i) activate or use more than one BidMuseum account (an "Account"); (ii) use a false or misleading address or e-mail address to activate or use a Member Account; nor (iii) provide false or misleading information to any entity involved in the BidMuseum Program.  Each individual user is to be registered to a single PayPal Member Account without exception, and merging of Member Accounts is prohibited. 

Each Member will be assigned a username and be required to select a password. Any duplicate or multi-person Member Accounts set up from the same PayPal account will be liable to cancellation, shall be considered a violation of these Terms and thereby disqualified from winning in a BidMuseum Auction. 


Registration Data 
 
Upon registration for any Service, a Member shall (i) provide true, accurate, non-misleading, current and complete information ("Registration Data"), (ii) maintain and promptly update the Registration Data to keep it true, accurate, non-misleading, current and complete, and (iii) refrain from assigning their Account or any rights associated with their Account to another person or entity. BidMuseum shall, at its sole discretion, determine what means of identification shall be appropriate for Member use of the Services, and may similarly further choose to limit a Member’s Registration Data.  BidMuseum may establish an Account for the Member, as a result of a Member registering and based on the Registration Data the said Member provides.

BidMuseum reserves the right, at its sole discretion, to suspend or terminate any Service then being provided to a Member as well as the Member’s Account, should BidMuseum believe the provided Registration Data to be untrue, inaccurate, misleading or incomplete. BidMuseum may similarly refuse to provide Members with any future use of the Services or any section thereof. Members acknowledge and consent to the use by BidMuseum of their Registration Data to send information and notices regarding Member Accounts and Services, as detailed in the Privacy Policy. BidMuseum will not be liable in the event that a Member fails to maintain accurate Registration Data, including, but not limited to, said Member’s failure to receive critical information about the Service or their Account.  Neither BidMuseum nor any of its third party providers shall be responsible for the verification of Member Registration Data. However, BidMuseum reserves the right to request at any time that certain Members provide proof in order to verify the accuracy of information provided by such Members at the time of registration or anytime thereafter.  Failure to provide such proof may result in immediate termination of the Member account without recourse. 


Username and Password

As indicated above, upon registration Members will be assigned a username, and requested to select a password. The username and password will allow a Member to view and manage their Account. Members acknowledge and consent to the processing of all Account transactions by BidMuseum, including, and without limitation to, the registration for additional Services initiated through the use of the username and password.  Members are solely responsible for ensuring the confidentiality of their username and password and must immediately notify BidMuseum of any unauthorized use of their username and password or any other breach of security. Members shall not allow any other person to transact through their account.  Notwithstanding the aforementioned, Members acknowledge and agree that they are responsible for any activities, charges and/or liabilities incurred as a result of the use of their username and/ or password, and that at no time will BidMuseum be liable for any use or misuse of their username and/or password.  BidMuseum reserves the right to make changes to usernames allocated for use of sections of its Services whenever need arises.  If necessary, and for purposes of continuing a Member’s use of a Service, BidMuseum will notify said Member of such changes. 


Unlimited Access

 
BidMuseum may allow Members or users to access certain Services without requiring registration, in which case BidMuseum, at its sole discretion, shall determine which Services and what level of access and use shall be permitted.


Member Misuse

BidMuseum.com has the right to take the following actions in response to any actual or suspected abuse by Members: In cases of suspected abuse, fraud, or breach of these Terms of Use, or the intent of these Terms of Use, BidMuseum shall be the sole determiner.  If such a case is detected, BidMuseum, may, at its sole discretion, terminate or suspend membership or access to the Services and the Site by a Member. At BidMuseum’s sole discretion, any Member suspected of trying to manipulate the Auction System in any way will be subject to immediate termination and any bids placed by said Member will be deemed null and void. If an auction is won through manipulation, the Member will not receive the item and may furthermore be liable to fines.  Possible manipulation of the system may include, but is not limited to, a Member having multiple accounts, having multiple BidMuseum accounts from one PayPal Account or having multiple accounts from a single address. Adding false names or e-mail addresses in the Refer-A-Friend Script with the aim of gaining bids illegally shall be construed as manipulation. Any Member who receives an item will be responsible for either returning the item or paying the Full Retail Price of the item to BidMuseum within 5 business days from the date of notification, in the event that manipulation of the system is suspected after said item has already been received. Failure to return said item or to facilitate full payment within the prescribed period may result in the matter being handed over to a collection agency for remedy. Any decisions taken by BidMuseum in relation to the termination or suspension of any Member’s account shall be final and binding. Members may terminate their membership at any time simply by contacting BidMuseum via the Contact Us page, and providing their account details for purposes of having them removed from our database. 


Payment Disputes

If for any reason a Member or user disputes any charge FOR BIDS from PayPal or BidMuseum, said Member or user shall be deemed to have breached this contract and will be liable to fines and and suspension of his account.  


Discontinuation of Services

BidMuseum may, at its sole discretion, change, suspend or discontinue any feature of the Services or the Site at any time without notice, should events beyond BidMuseum’s control occur. Such events include, but are not limited to, computer equipment or electronic data transmission failure, strikes, civil disturbances, acts of nature, acts of terrorism or acts of war. At any time, BidMuseum may cancel the entire BidMuseum Auction Program for any reason, at its sole discretion and without notice. Winning items will be shipped within 1 - 4 weeks from the date when the auction closed. 


Cancellations, Returns and Refunds

ALL BID PACKAGE PURCHASES ARE CONSIDERED TO BE A FINAL SALE AND ARE NON-REFUNDABLE. Auction winners on BidMuseum.com have the unconditional right to cancel an order. Such rights are valid on conclusion of the contract. Users will be entitled to a refund of the auction end price they have paid in relation to the contract, even if the goods are not defective in any way, provided that they cancel a contract to which the cancellation provisions are applicable. These cancellation rights are only valid for seven days after the date on which a winner received the goods or a notification that the goods are ready for collection. Audio or video recordings and computer software unsealed by the client are excluded from this right to cancel and are not eligible for return or refund. Members and users intent to cancel the contract must express in writing via e-mail, or mail to BidMuseum.com, stating their wish to cancel within the time period noted above. Members and users must return the received product or products in good condition, such as might be expected during normal product testing at a retail store, in order to effect a valid cancellation or return. Members and users shall be responsible for all costs incurred during postage of goods, unless goods are found to be faulty. Members and users will be liable to pay compensation to BidMuseum [the amount refundable will be reduced proportionally], as applicable, in the event that said Members and users are only able to return the product or service in part or only in a depreciated condition. Members and users may not be entitled to a refund should BidMuseum deem the returned goods to be in very bad condition.
Any additional costs incurred by BidMuseum.com due to insufficient postage on the return or for courier shipments and other irregular shipping methods that are over and above postal shipping costs shall be deducted from payments remitted by the client. Incomplete sets and boxes returned will not be accepted. Refund requests should be sent to BidMuseum within 7 days of receiving the won item (also applicable for faulty items).


Interruption, Discontinuation or Limitation of Services

BidMuseum reserves the right to at any time modify, suspend, discontinue or permanently cancel the Site or the Services, or sections thereof, without prior notice to Members or users. In the event that the Service, or any part thereof, for which a Member or user is registered, is permanently discontinued or cancelled by BidMuseum, without limiting the aforementioned, BidMuseum further reserves the right to suspend, terminate, revalue or modify, without liability, or notice, any current or past auction.  


Unlawful Use of Services

Subject to the conditions in these Terms of Use, the Privacy Policy and any applicable Rules, Members and users acknowledge and agree that the Site and Services are solely for their personal use.  Members and users shall therefore not transmit, broadcast, upload to any computer or mobile device, create derivative works of, or make commercial use of the Site or Services in any manner.  Members and users shall not attempt to or otherwise authorize, encourage or support the attempts of third parties to circumvent, re-engineer, decrypt, break or otherwise alter or interfere with the Site or Services in any manner.


User Fees

 
From time to time, BidMuseum may, at its discretion, charge fees and other charges (the "Fees") for the use of certain Services for which a Member is registered.  Such Fees, if any, will be disclosed on the Site or to the Member prior to their use of a particular Service, and their use of the Service shall constitute their agreeing to pay all applicable Fees.  Payment of Fees that result from use of the Service from or through a Member’s Account, remains the responsibility of said Members, whether or not used by the particular Member.  Information on Fees shall be available to Members under their respective Account information.  Unless otherwise indicated to Members by BidMuseum in writing, Fees shall be due immediately and are non-refundable.  All Fees are subject to change and BidMuseum will provide notice of any changes in Fees on the Site or to Members prior to the new Fees taking effect. A Member may immediately cancel their Account upon receipt of a notice of change in fees by BidMuseum. Further use of a Service by a Member or user, after notice of a change in Fees is issued, shall be construed as their having agreed to the new Fees. 


Intellectual Property Rights
 
The following marks: BidMuseum, BidMuseum.Com, BidMuseum Auctions, and the BidMuseum logos are all trademarks of “Inlapp”. All other trademarks are the property of their respective owners. Inlapp retains ownership of the copyrights and trade dress rights of the website, graphics and logos of BidMuseum. No use of any intellectual property rights of BidMuseum is permitted without the prior express written permission of Inlapp. 


Electronic Communications
 
The access and use of the Site or registration for or use of a Service by a Member implies consent to receive electronic communications from BidMuseum. BidMuseum may communicate with Members via any means as submitted in Registration Data or electronically via e-mail, instant messenger or by posting notices on the Site. Members agree that all agreements, notices, disclosures and other electronic communications from BidMuseum are in compliance with any legal requirements that such communications be in writing. BidMuseum will not be responsible for e-mails or other communications not received by the Member. 


Third Party Links, Products and Services
 
Links on the Site to other websites belonging to BidMuseum’s advertisers, business partners, affiliates and other third parties or links by third parties to the Site shall not constitute an endorsement by BidMuseum of those websites, nor the products or services made available thereon, nor is BidMuseum responsible for the activities or policies of those websites. BidMuseum may also avail products and services of such advertisers, business partners, affiliates and other third parties directly on the Site, which products or services shall be purchased and/or obtained by Members and users directly from such advertisers, business partners, affiliates and other third parties. Members and users acknowledge and agree that BidMuseum shall not be a party to, or be in any way responsible for any transaction concerning products or services made available from such advertisers, business partners, affiliates and other third parties or for any content or information presented in connection with any products or services of advertisers, business partners, affiliates and other third parties.  Shipping of winning products will be carried out within 1 - 4 weeks of the date when the product is paid for. 


Electronic Equipment and Related Costs
 
Members and users are solely responsible for obtaining, maintaining and paying for all charges and fees associated with the obtaining and maintenance of all telephone, computer hardware, Internet access services and other equipment or services needed to access and use the Site and/or the Services. Members shall provide all equipment and software required to connect to the Service and shall ensure that the operations, the Site or the Services of BidMuseum.com are not disturbed or interfered with in any way whatsoever by the equipment and/or software of a Member or user. If any upgrade in or to the Site or the Service requires changes in your equipment or software, such changes shall be effected at the Member’s or user’s expense. Any new or additional features of the Site or Service, including the release of new products and Services, shall be subject to these Terms of Use unless their exclusion is expressed in writing.


Limitations of Liability 
 
Disclaimer of Warranties

BidMuseum UNDERTAKES TO PROVIDE THE SITE AND SERVICES TO MEMBERS AND USERS ON AN "AS-IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PROVIDED BY APPLICABLE LAW, NO RERESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT, AS TO THE OPERATION OF THE SITE, THE SERVICES OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON OR AVAILABLE IN CONNECTION WITH THE SITE OR THE SERVICES, SHALL BE INTERPRETED AS HAVING BEEN MADE BY BidMuseum. WITHOUT LIMITATION TO THE AFOREMENTIONED, NO REPRESENTATIONS, WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, CORRECTNESS, COMPLETENESS, QUALITY OR MISDELIVERY OF THE SITE OR INFORMATION TRANSMITTED VIA THE SERVICES, NOR THE SAFETY, SECURITY, RELIABILITY, TITLE, TIMELINESS, MERCHANTABILITY, CONFORMITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THE SITE OR SERVICES, INFORMATION TRANSMITTED VIA THE SERVICES OR THE SERVICES SHALL BE INTERPRETED AS HAVING BEEN MADE BY BidMuseum. EACH MEMBER OR USER WILL HAVE THE SOLE RESPONSIBILITY OF INDEPENDENTLY EVALUATING THE SITE AND SERVICES TO ENSURE THE ACCURACY, CORRECTNESS, COMPLETENESS, SAFETY, SECURITY, RELIABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  WITHOUT LIMITATION TO THE AFOREMENTIONED, NO REPRESENTATION, WARRANTY OR GUARANTEE THAT THE SITE OR SERVICES ARE FREE OF INFECTION FROM ANY VIRUSES, WORMS, TROJAN HORSES, TRAP DOORS, BACK DOORS, EASTER EGGS, TIME BOMBS, CANCELBOTS OR OTHER CODE OR COMPUTER PROGRAMMING ROUTINES THAT CONTAIN CONTAMINATING OR DESTRUCTIVE PROPERTIES OR THAT ARE INTENDED TO DAMAGE, DETRIMENTALLY INTERFERE WITH, SURREPTITIOUSLY INTERCEPT OR EXPROPRIATE ANY SYSTEM, DATA OR PERSONAL INFORMATION SHALL BE INTERPRETED AS HAVING BEEN MADE BY BidMuseum.  MEMBERS AND USERS EXPRESSLY AGREE THAT THEIR USE OF THE SITE AND SERVICES IS AT THEIR SOLE RISK. 
 
WHETHER OR NOT SUFFICIENTLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AT NO TIME SHALL BidMuseum OR ANY OF ITS DIRECTORS, EMPLOYEES, OFFICERS, REPRESENTATIVES, SHAREHOLDERS, AGENTS, INDEPENDENT CONTRACTORS, PARTNERS, LICENSORS, SUPPLIERS OR AFFILIATES BE HELD RESPONSIBLE OR LIABLE TO ANY MEMBER, USER OR THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), INDEMNIFICATION, STRICT LIABILITY OR OTHERWISE, FOR ANY DAMAGES, INCLUDING, BUT NOT LIMITED TO, PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL, INCLUDING, AND WITHOUT LIMITATION TO, DAMAGES FOR ANY LOSS OF PROFIT, REVENUE, GOODWILL, BUSINESS, PROCUREMENT COSTS, LOSS OF USE, OR ANY OTHER INTANGIBLE LOSS, AS A DIRECT OR INDIRECT RESULT OF: (I) VIOLATION OR BREACH OF THESE TERMS OF USE, THE PRIVACY POLICY, ANY APPLICABLE RULES, OR THE LAW BY A MEMBER OR USER; (II) MEMBERS OR USERS ACCESSING THE SITE OR SERVICES; (III) A THIRD PARTY ACCESSING OR USING THE SITE OR SERVICES UNDER THE USERNAME OR PASSWORD OF A MEMBER; (IV) A MEMBER OR USER BEING UNABLE TO ACCESS OR USE THE SITE OR SERVICES FOR ANY REASON OR FOR ANY PERIOD OF TIME; (V) MEMBERS OR USERS DOWNLOADING OF ANY SOFTWARE OR CONTENT; (VI) A MEMBER’S OR USER’S RELIANCE UPON OR USE OF ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES; (VII) THE BREACH OF THE SITE’S SECURITY; OR (VIII) THE DISCLOSURE OF A MEMBERS PERSONAL INFORMATION WITHOUT PERMISSION. WITHOUT LIMITATION TO THE AFOREMENTIONED, THE LIABILITY OF BidMuseum IS LIMITED TO ACTUAL DIRECT DAMAGES OF THE MEMBER OR USER NOT IN EXCEEDING THE AMOUNTS PAID, IF ANY, BY THE SAID MEMBER OR USER TO BidMuseum FOR USE OF THE SITE AND SERVICES.
 
 
BidMuseum will not be responsible for any damage to any Member's or user's equipment, computer, software, phone or wireless device incurred while using the Service or downloading of any software or information necessary to use the Service, without limiting the aforementioned. Furthermore, BidMuseum has made no express or implied guarantee as to service level. The Site and Services may be interrupted from time to time and may not always be secure from viruses or errors.
BidMuseum will not be responsible in the event of errors in transmission, lost or unavailable network connections, e-mails not delivered, faulty telephone and wireless connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions in connection with the Site or Services.

In the event that a Members state or country legislation prohibits limitations on certain warranties or damages, said Member may be excluded from the application of some or all of the above disclaimers, exclusions or limitations.


Indemnification Of BidMuseum
 
Members and users agree to defend, indemnify and hold harmless BidMuseum and its officers, directors, shareholders, employees, independent contractors, agents, representatives, partners, licensors, suppliers and affiliates and other Members or users of the Site or Services from and against all claims, actions, demands, liabilities, settlements and expenses, including, but not limited to, attorneys' fees and costs, arising out of, or related to: (i) any breach or violation of these Terms of Use, the Privacy Policy or any applicable Rules or law by a Member or user; (ii) the  failure by a Member to provide accurate, complete, non-misleading and current Registration Data; (iii) access or use of the Site or Service by a Member or by a third party using the username and password of an existing Member; and (v) the use of any prize by a Member.


Injunctive Relief 
 
Failure to enforce these Terms of Use, the Privacy Policy or any applicable Rule would result in irreparable damage to BidMuseum, for which damages at law would prove an inadequate remedy. As a result, in the event of any breach or threatened breach of these Terms of Use, the Privacy Policy or any applicable Rule by the Member or user, BidMuseum shall be entitled, in addition to all rights and remedies, to an injunction restraining such further breach or threatened breach, to post an injunction bond, and/ or to a decree for specific performance of the provisions of these Terms of Use, the Privacy Policy or any applicable Rules, without having to provide proof of actual damage. Members and users consent to the exclusive jurisdiction of the courts of New Delhi, India over any action or proceeding with regards to an injunction in connection to these Terms of Use, the Privacy Policy or any applicable Rule. Members and users further consent to the jurisdiction of such a court and hereby waive any objections to having the venue for such action or proceeding in New Delhi, India. Members and users agree that service of any court paper may be affected upon their person by mail or in such other manner as may be provided under applicable laws, rules of procedure or local rules.


Applicable Law, Venue and Jurisdiction

All judgments rendered in relation to any reward shall be deemed final and binding on the Member or user on the one part and BidMuseum on the other, and on both parties’ respective administrators, executors, legal representatives, heirs, successors and assigns, and may only be entered in the records of state courts of New Delhi, India. Similarly, the state and/or federal courts in and for New Delhi, India shall have the right of venue as well as exclusive jurisdiction over any suit filed for purposes of injunctive relief, compelling arbitration or enforcing an arbitration arising from, under or connected with the Site, the Services, the Auction Program, these Terms of Use, the Privacy Policy or any applicable Rules. Parties therefore waive any objection to the said jurisdiction or venue on the grounds of forum non convenience or otherwise. Respective attorney’s fees will remain the responsibility of the represented party.


Arbitration 
 
These Terms of Use, the Privacy Policy and any applicable Rules are governed by and shall be construed in accordance with the internal laws of India, without regard for any conflicts of laws principles, and with the express exclusion of the United Nations Convention on the International Sale of Goods. The commercial arbitration rules of the courts of New Delhi, India shall be final and binding on any civil action, dispute, claim or proceeding arising from or relating to the Site, the Services, the Auction Program, these Terms of Use, the Privacy Policy or any applicable Rules, except in the case of an injunctive order as discussed above. Arbitrators shall be appointed by BidMuseum at the latter’s discretion.


Miscellaneous 
 
Access of the Site by Members and users is limited to sections specifically made available to Members and users. Members and users are restricted from accessing or attempting to access the Site or any section thereof with the intention of violating Site security or the security of any systems that may be accessed through the Site. BidMuseum will not be liable in the event of any loss or damage resulting from unauthorized interception or decryption of information submitted through BidMuseum.com. Members and users consent to refraining from unsportsmanlike conduct or abuse of Services by conduct that is or may be harmful to the interests of BidMuseum or third parties. BidMuseum has the sole discretion, to terminate Accounts and effect the cancellation of all bids by any Member or user suspected of engaging in illegal, fraudulent, manipulative or abusive activities. Thereafter, BidMuseum may refer the said Member or user to the appropriate law enforcement agencies. BidMuseum is entitled to, but not obligated, to monitor the access and use of the Site and Services by Members or users. Members and users agree not to: (a) use any automated means other than the tools offered on the site to place or accumulate Bids; (b) interfere with or manipulate the Services or any affiliated program in any way; (c) present false or misleading information; (d) obtain or use Bids in violation of these Terms of Use or that were erroneously credited to a Member's or user's Account; nor (e) assist other persons or entities in conducting fraudulent, illegal, abusive or manipulative activity. BidMuseum has taken due measures to ensure that all information on the Site pertaining to products, services and/or activities is of the utmost accuracy. BidMuseum however does not guarantee such accuracy and shall not be liable in the event of any errors and/or omissions encountered. Because of variations due to printing, computer monitors and/or updates from manufacturers, Auction Items as pictured on the Site may not necessarily reflect the exact models and colors of actual rewards. Prior to participating in any BidMuseum Auction or Service, Members and users are advised to consult competent tax advisers as BidMuseum does not offer any tax related services. This remains the sole responsibility of each Member and user. In the event that a court of competent jurisdiction deems any part of these Terms of Use, the Privacy Policy or any applicable Rules to be unlawful, void or unenforceable, the entire Terms of Use, Privacy Policy or Rules shall not be deemed unlawful, void or unenforceable, but only that section of the Terms of Use, Privacy Policy or Rules that is so deemed shall be struck out or revised in a way that the original intent is retained.
